Selling a House With a Tenant in Missouri

Yes. You can sell a Missouri rental with a tenant in it, but the sale does not cancel the lease. You either sell to a buyer who takes over the lease, wait for the lease to end, or reach a written move-out agreement with the tenant. Month-to-month tenancies end with at least one month's written notice under Missouri law.

Start with the lease, not the listing

Before you set a price or a date, read the lease. Three things decide your plan: when it ends, whether it says anything about a sale or showings, and how much notice it requires before you enter. A buyer and their lender will ask for a copy, so have it ready along with the rent amount, the deposit held and any written changes.

Lease type changes the timeline

  • Fixed-term lease: the tenant generally has the right to stay until the term ends. A sale moves the landlord role to the buyer; it does not end the lease on its own.
  • Month-to-month: Missouri law lets either side end it with written notice that ends the tenancy on a rent date at least one month after the notice is received (RSMo 441.060). An unwritten tenancy is treated as month-to-month.

Notice rules have details and exceptions, so have an attorney review the notice before you send it.

Three ways to sell a rental

1. Sell with the tenant in place

Your buyer pool is mostly investors who want the rent from day one. Expect them to look closely at the rent amount, the payment history and the lease term. This path keeps the income coming while you sell, but owner-occupant buyers usually cannot use the home until the lease ends.

2. Sell after the tenant moves out

A vacant home is easier to prepare, photograph and show, and it opens the sale to owner-occupant buyers. The tradeoff is carrying costs: mortgage, taxes, insurance and utilities with no rent coming in. Put those months on your net sheet before deciding.

3. Agree on an early move-out

Some owners offer a tenant moving help or a rent credit in exchange for leaving by a set date. Put any agreement in writing, signed by both of you, and ask an attorney to review it.

Showings with a tenant at home

The tenant is your partner in the sale whether you plan for it or not. A few steps keep things smooth:

  • Talk with the tenant before the sign goes up, and explain the timeline.
  • Follow the lease's entry terms and give clear notice of every showing.
  • Group showings into set windows so the tenant is not interrupted every day.
  • Ask about pets, valuables and work-from-home schedules before photos.

Security deposits at closing

Missouri caps a residential deposit at two months' rent, and when a tenancy ends the landlord has 30 days to return the deposit or send an itemized list of damages (RSMo 535.300). If the tenant stays after the sale, the deposit is usually credited or transferred to the buyer at closing. Your title company and the contract set exactly how.

City inspections still apply

Many cities in the area require an occupancy inspection when a home sells, and some have separate rules for rentals. See occupancy permits in St. Louis County cities and check the rule for your address early.

How I plan a tenant-occupied sale

I start with the lease and a side-by-side net sheet: sell with the tenant, sell vacant, or sell after an agreed move-out. Then we set a showing schedule the tenant can live with. Frequently asked questions

Does selling my house end my tenant's lease in Missouri?

No. A sale generally does not end the lease on its own. The buyer usually takes over as landlord until the lease ends.

How much notice do I give a month-to-month tenant in Missouri?

Missouri law requires written notice ending the tenancy on a rent date at least one month after the tenant receives it (RSMo 441.060). Have an attorney review the notice.

Who gets the security deposit when a rental sells?

If the tenant stays, the deposit is usually credited or transferred to the buyer at closing as the contract and title company direct.

Is it better to sell a rental vacant?

Often, because more buyers can consider it, but carrying costs rise. Compare both on a net sheet before you decide.

Can I show the house while a tenant lives there?

Yes, following the lease's entry terms. Clear notice and set showing windows help keep the tenant cooperative.
