Do I Need a Lawyer to Sell a House in Missouri?

Usually not. Missouri does not require an attorney to sell a home, and in the St. Louis area a title company normally handles the closing and the money. It is smart to call a real estate attorney when the sale is not standard: an estate or trust, a divorce, a title problem, a tenant, seller financing, or any document that is not a standard form.

Who does what in a typical Missouri sale

  • Your agent: pricing, marketing, negotiating and completing the standard contract forms used in your area.
  • The title company: title search, title insurance, the settlement statement, collecting and paying out funds, and recording the deed. A Missouri title industry guide says title companies normally provide closing services for residential properties (WFG National Title).
  • An attorney, when needed: legal advice and documents that go beyond standard forms.

Some states require an attorney at closing. Missouri is not one of them; a 2026 state-by-state list notes attorneys are not essential for closing in Missouri (HomeLight, updated September 2026).

Why some documents need a lawyer

Missouri law defines drawing papers that affect someone's rights, for pay, as law business (RSMo 484.010). Court decisions allow agents and title companies to complete standardized forms as part of a transaction, but custom documents and legal advice belong to an attorney. A title industry guide gives party wall and joint driveway agreements as examples that need an attorney (WFG National Title).

When to call a real estate attorney

  • Estates and trusts: who has authority to sign, probate steps, or several heirs who must agree. See selling an inherited house in Missouri.
  • Divorce or separation: a court order may control the sale and the proceeds.
  • Title issues: liens, judgments, boundary questions, missing heirs or an old mortgage that was never released.
  • Tenants: notices and move-out agreements. See selling a house with a tenant.
  • Seller financing or a lease-option: notes, deeds of trust and terms that are not on a standard form.
  • Selling without an agent: an attorney can draft or review your contract. See selling by owner in Missouri.
  • A dispute: a buyer threatens to sue, or a contract deadline is in question.

What an attorney review usually costs

Fees vary. Many real estate attorneys offer a flat fee for a contract review or a single document, and hourly rates for more complex work. Ask for the fee in writing before they start.

How to keep a simple sale simple

  1. Confirm everyone on the deed is ready and able to sign.
  2. Ask the title company to open the file early so title issues surface before you list.
  3. Use the standard forms for your area and read every page before signing.
  4. Write down anything unusual (a shared driveway, a tenant, an estate) and get legal advice on just that item.
  5. Confirm wire instructions by phone using a number you already trust.
